Mr. Saler recently mediated a high value, medically complex personal injury case, in which the parties started the day far apart. What he accomplished was phenomenal. We began the session early in the morning because the Final Status Conference was at 1:30 p.m. Trial was the following day. Just before noon, Mr. Saler called the court clerk and obtained an extension of time to 3:00 p.m. Since negotiations were ongoing at 2:00 p.m., and we had to go to court, he followed us in his car to the downtown courthouse. When he arrived in the courtroom, he asked the judge for more time. He continued to mediate the case in the jury room and he settled it a few minutes before 5:00 p.m. I have never seen any mediator show such commitment and dedication. I have to say that he is the best mediator with whom I have ever had the pleasure of working.

Alan Saler was recommended by one of the two defense attorneys to mediate a premises liability action. She touted him as a mediator who works very hard to settle a case. As it turned out, our matter was no exception. In my experience, when a case does not settle during the mediation session, most mediators take their fee, close the door, and say sorry I could not get the job done. Not however, Mr. Saler. Although our matter did not resolve during the mediation session, Mr. Saler did not give up. In fact, during the following five weeks he repeatedly communicated by telephone and email messages with me and both defense counsel. His considerable effort resulted in separate settlements with both defendants. Not only that, he greatly assisted me in resolving outstanding bills that had to be paid from the settlement proceeds, and to further facilitate the settlement, he did not charge for his additional time. |

The case was problematic because my client complained of multiple injuries to her neck, back, shoulder and knee however, the MRI scans and other films were all negative, making it no more than a glorified soft tissue case. Thank you again for your assistance in resolving our matter, which required a considerable amount of skill on your part to bring the parties with their widely divergent interests together to reach a settlement. These interests included those of the plaintiff, who sustained a serious back injury requiring surgery and life time medical treatment; a plaintiff-in-intervention who had expended more than $150,000 for medical expenses and salary in lieu of temporary disability; the defendant whose insurance policy was canceled before the loss giving rise to plaintiff's injuries and who was threatening to file bankruptcy if the matter could not be settled so as to avoid a jury trial; an insurance broker as a cross-defendant as to whom it was alleged that he had wrongfully appropriated payments made by the defendant for their liability insurance and failed to keep the insurance policy in force and effect; and, finally, the E & 0 carrier for the insurance broker which contended that it had a very strong claim for rescission of the insurance policy based on the broker's fraud in completing the application and his other apparent misconduct. You were able to navigate the shoals of the controversy in a way which led to a settlement which avoided the bankruptcy proceedings and a complicated trial, whether in the Superior Court or in the bankruptcy arena. |
