Ernest C. Brown, ESQ, PE is a highly accomplished trial lawyer and project counsel. He has advised more than $10 billion in US and International Construction Projects. He has also been chief trial counsel in global construction disputes such as the Central Arizona Project Pipeline failure ($146 million, Defense Verdict) and the June 6, 1985 Southern California Edison Powerplant Disaster ($250 million in property damage and six deaths; minimal settlement for his client).

As a mediator, arbitrator and litigator, he has resolved more than 2,500 construction disputes in state and federal court, including jury trials, bench trials, arbitrations, DRB’s and other ADR solutions.

He is a graduate of MIT in Civil & Environmental Engineering. While working as a project engineer and superintendent, he completed an MSCE in Project Management and JD (Law) from the University of California, Berkeley. He also did coursework at Harvard Law School in International Law and the Law of the Sea. He is a registered Professional Engineer and member of the State Bar of California.

His practice emphasizes engineering and construction megaprojects (over $500 million) and related complex disputes. He has resolved major contract disputes, construction disasters and related litigation on airports, bridges, highways, high rise office buildings, refineries, pipelines, storage tanks, water and wastewater treatment plants, and a myriad of other projects.

Ernest also serves the construction industry and public sector as a Mediator, Arbitrator and Special Master for the American Arbitration Association. He has mediated more than 600 construction cases and serves as AAA Panel Chairman on cases ranging up to $100 Million.

International Projects

While at Fluor Corporation, one of the world’s largest engineering and project management companies he advised large and complex international projects. These included the Saudi Petrochemical Project ($3.4 billion), the PERTAMINA Oil Refinery in Chilachap, Indonesia, the Kemya Project in Saudi Arabia, and several projects in Alaska, Chile, Canada, the UAE and Indonesia.

Mr. Brown is a graduate of MIT in Civil and Environmental Engineering and earned a MS Construction Management and JD from the University of California, Berkeley. He also did graduate coursework at Harvard Law School in International Law. He is a senior construction lawyer and licensed civil engineer.

Memberships & Affiliations

Mr. Brown is a member of the California Bar Association, the American Bar Association Forum Committee for the Construction Industry, the ADR and Mediation Sections of the Bar Association of San Francisco, the National Society for Professional Engineers, and is a former Chairman of the Legal Advisory Committee of the Associated General Contractors of California.

Rates Information

Mediation: $8,000 Per Day (unlimited hours) The $8,000 Per Day rate includes any pre-mediation reading and preparation time. Partial days of mediation (6 hours minimum) and telephone conferences billed at $525 hourly rate. Mediations outside of San Francisco or Sacramento result in a flat travel and lodging fee of $1500.00 for travel time, travel costs, lodging and meals expenses. Arbitration: $4,500 per day.
